Terms of Use and Privacy Policy


Consent to Participate

By accessing or using the MyCHOP Mobile Application ("MyCHOP" or "Mobile App"), you are consenting to participate in CHOP's MyCHOP communication services platform. Your decision whether or not to participate will not affect your current or future relationship with your physicians or CHOP. If you decide to participate, you are free to withdraw at any time without affecting those relationships.

MyCHOP User Responsibilities

By accessing or using MyCHOP you accept and agree to be bound by these MyCHOP Terms of Use and Privacy Policy. Please read these terms and conditions carefully before accessing or using MyCHOP. It is important to review these documents periodically as we may modify them at any time, and you agree that such modifications are effective and binding upon you immediately upon posting of the modified version. Throughout these terms and conditions, The Children's Hospital of Philadelphia is referred to as "CHOP," "we," or "us."

You agree that MyCHOP is a communication service offered as a convenience to CHOP patients and/or their parents or legal guardians. You understand that it provides online access to portions of your/your child's CHOP electronic medical record and other services that CHOP may offer now or in the future, including telemedicine services, and that you are solely responsible for any sharing of MyCHOP content that you intentionally or unintentionally communicate to others. You understand that email messages sent using MyCHOP will be routed to the appropriate department at CHOP, as necessary for handling, and CHOP employees, in addition to your/your child's healthcare provider, may be involved in addressing your request. Therefore, use of MyCHOP may not be appropriate if there is sensitive information that you would only wish to discuss directly with your/your child's provider.

You agree that you will not use MyCHOP to transmit any false, defamatory, malicious or offensive material.

Discontinuing Use of MyCHOP

You can discontinue your use of MyCHOP at any time by contacting your CHOP provider's office. We reserve the right, at our sole discretion, to discontinue your use of MyCHOP or any service offered within MyCHOP at any time.

HIPAA Privacy Statement

CHOP has in place policies and procedures regarding access to medical records by our staff and employees and has outlined the circumstances under which your/your child's medical information may be released to parties outside the organization. These policies conform to state and federal law and are designed to safeguard your/your child's privacy. Our staff and employees are educated in CHOP confidentiality policies and the appropriate use of medical information. A CHOP patient's medical information is held in strictest confidence. For more information regarding how CHOP may use and share patient information please refer to our statement on HIPAA, HIPAA: Protecting Patient Privacy.

Your/Your Child's Medical Record

As we provide your/your child's health care, we are required to maintain documentation of your/your child's medical history, current conditions, treatment plan and all treatments given, including the results of all tests, procedures and therapies. You understand that you may receive email messages, test results and other communications delivered via MyCHOP. You understand that not all of your/your child's CHOP electronic medical record may appear on your/your child's MyCHOP in accordance with applicable state and federal privacy laws.

Messages you send via MyCHOP may be made part of your /your child's permanent medical record and may be used at the discretion of the physician or support staff. Once your communication it is made part of your/your child's record, it will be accessible to current and future CHOP staff members who are appropriately involved with your/your child's care. All CHOP generated electronic medical record content is subject to all state and federal statutes governing the security and confidentiality of medical records.

Urgent Matters/Messages

MyCHOP should never be used for urgent matters including attempts to contact your/your child's physician regarding an immediate medical concern. Delays can occur based upon volume, availability of staff and the complexity of your condition. FOR URGENT MEDICAL MATTERS, CALL 911 OR YOUR LOCAL EMERGENCY SERVICES PROVIDER.

If your/your child's physician is out of the office or unavailable to respond, messages sent via MyCHOP may be routed to other authorized caregivers within CHOP in order to facilitate a timely response to your request. All communications between you and your CHOP health care team using MyCHOP are carried over a secure, encrypted connection directly into the CHOP electronic medical record. While you may receive Internet e-mail messages notifying you of new messages in your MyCHOP Inbox, these e-mails will not contain any confidential medical information. You will need to log directly into the secure MyCHOP application to view your/your child's medical information.

Telemedicine Services

CHOP may offer telemedicine services through MyCHOP to you/your child at its discretion. Currently the telemedicine services are offered through MyCHOP Video, a platform that is available through MyCHOP. You will be asked to accept a MyCHOP Video Consent and Acknowledgement with instructions for accessing these services prior to receiving them. The Privacy Policy and CHOP’s statement on HIPAA, HIPAA: Protecting Patient Privacy, apply to telemedicine services.

User ID(s) and Password(s)

It is your responsibility to keep your MyCHOP User ID and Password, and additional User IDs and Passwords you may receive for telemedicine or other services, in a secure location and completely confidential. Anyone with access to your MyCHOP User IDs and Passwords will be able to view your/your child's medical information and communicate with your/your child's health care team as if that person were you. It is your responsibility to prevent disclosure of your temporary access code and Password and to change your Passwords and Password hints if you feel that your security has been compromised. CHOP will not be liable for any damages that results from your failure to keep your Password secure. You can change your Passwords and Password hints online at any time.

Copyright and Trademarks

All content included on CHOP Web sites, including, but not limited to, text, photographs, graphics, button icons, images, artwork, names, logos, trademarks, service marks and data (the "Content"), in any form, are protected by U.S. and international copyright law and conventions. The Content includes both Content owned or controlled by CHOP and Content owned or controlled by third parties and licensed to CHOP. Except as set forth below, direct or indirect reproduction of the Content, in whole or in part, by any means, is prohibited without the express written consent of CHOP.

Site Access and Licenses

CHOP grants a limited license to each user to make personal use only of this Mobile App and the associated services in accordance with these terms and conditions of use. This license expressly excludes, without limitation, any reproduction, duplication, sale, resale or other commercial use of this Mobile App and the associated services, making any derivative of this Mobile App or the associated services, the collection and use of user email addresses or other user information, including, without limitation, health information or any data extraction or data mining whatsoever.

Security

This Mobile App uses encryption software. However, no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information. When using MyCHOP, information will be transmitted over a medium that is beyond the control of CHOP and its contractors. YOU HEREBY EXPRESSLY ASSUME THE SOLE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THIS SERVICE. Once the information is received by us, your/your child's medical information will be treated as confidential and given the same protection that all other CHOP medical records are given.

No Warranties

MyCHOP AND ALL OTHER MOBILE APPLICATIONS AND WEB SITES HOSTED BY CHOP AND THE CONTENT ARE PROVIDED BY CHOP ON AN "AS IS" BASIS. CHOP MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED AS TO THE OPERATION OF MyCHOP, OR THE CONTENT, PRODUCTS AND/OR SERVICES INCLUDED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, CHOP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND/OR INFRINGEMENT. MyCHOP may not be available to you at all times due to system failures, procedures, maintenance or other causes beyond the control of CHOP. Access to MyCHOP is provided as an "as-is, as-available" basis and CHOP does not guarantee that you will be able to use MyCHOP at any particular time. During times when MyCHOP is unavailable, other communication methods (e.g., telephone) should be used to access CHOP.

Limitation of Liability

YOU UNDERSTAND AND AGREE THAT IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY OTHER USER OF MyCHOP FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ANY OTHER MONETARY OR OTHER DAMAGES, FEES, FINES, PENALTIES, LOSS OF REVENUE OR BUSINESS OR LIABILITIES ARISING OUT OF OR RELATING IN ANY WAY TO MyCHOP, OR SITES ACCESSED THROUGH MyCHOP, AND/OR CONTENT OR INFORMATION PROVIDED ON OR THROUGH MyCHOP. YOU ACKNOWLEDGE AND AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH MyCHOP IS TO STOP USING IT.

By downloading or viewing information on MyCHOP, you agree to indemnify CHOP and any of our parent or subsidiary companies or organizations, and any of our successors, assigns or licensees, together with any of their respective officers, directors and employees, against any damages, losses, liabilities, judgements, costs or expenses (including reasonable attorneys' fees and costs) arising out of a claim by a third party relating to your use of MyCHOP or the information contained therein, or any breach or violation of these terms and conditions.

Some of the material on MyCHOP is provided by third parties, such as lab results provided by your lab service provider, and CHOP shall not be held responsible for any such third-party material. CHOP disclaims any responsibility for or liability related to such third-party material. Any questions complaints or claims related to any product should be directed to the appropriate third party.

Proxy Access

CHOP patients aged 13-18 will be provided with patient accounts, and parties with parental rights or legal guardianship over these CHOP patients will be provided with proxy accounts. Due to state and Federal law, certain categories of medical information for children ages 13-18 may not be viewed without consent from the patient. As a result, these protected categories will not be available via a parent's or legal guardian's proxy account. A parent or legal guardian may request access to this information with the patient's consent through CHOP's medical records request process.

General

You expressly and irrevocably agree that exclusive jurisdiction for any dispute with CHOP, or in any way relating to your use of MyCHOP resides in the courts of the Commonwealth of Pennsylvania and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the Commonwealth of Pennsylvania in connection with any such dispute including any claim involving CHOP, or CHOP's parent corporation, affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.

You agree that any legal proceeding against CHOP related to MyCHOP shall be filed and tried only in the Court of Common Pleas for Philadelphia County, Pennsylvania, United States of America. Both parties hereby expressly waive any right to a jury trial in any such proceeding.

These terms and conditions are governed by the internal substantive laws of the Commonwealth of Pennsylvania, without respect to its conflict of laws or choice of laws principles. If any provision of these terms and conditions is found to be invalid by any court having jurisdiction, then the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect. No waiver of any of these terms and conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

CHOP may modify these terms and conditions at any time and without prior notice to you to reflect changes in our information practices or relevant laws by posting revisions on this Mobile App. You agree to review these terms and conditions each time you use MyCHOP so that you are aware of any modifications made to these policies. By accessing or using MyCHOP, you agree to be bound by all of these terms and conditions as posted at the time of your access or use, including the Privacy Policy then in effect.

Privacy Policy


The Children's Hospital of Philadelphia ("CHOP") has created these policies to demonstrate its commitment to privacy. It discloses our information-gathering and dissemination practices for the MyCHOP Mobile Application ("MyCHOP" or "Mobile App").

User IDs and Passwords

It is your responsibility to keep your MyCHOP User ID and Password, and additional User IDs and Passwords you may receive for telemedicine or other services, in a secure location and completely confidential. Anyone with access to your MyCHOP User IDs and Passwords will be able to view your/your child's medical information and communicate with your/your child's health care team as if that person were you.

Once you have logged in using your MyCHOP User ID and Password, this Mobile App will remain logged in unless/until you log out, meaning anyone who can access your mobile device will be able to access any information you may store or access on this Mobile App.

It is your responsibility to prevent disclosure of this information, your temporary access code, User ID and Password and to change your Passwords and Password hints if you feel that your security has been compromised. CHOP will not be liable for any damages that results from your failure to keep your information and Password secure. You can change your Passwords and Password hints online at any time.

Use of Data

This Mobile App is intended to serve as an online patient health portal for patients and families of CHOP with capabilities that include scheduling appointments, participating in telemedicine services, sending messages to CHOP healthcare providers, and accessing your/your child's health information. By using the Mobile App, you agree to use the Mobile App solely for these intended purposes and to grant CHOP a perpetual, non-exclusive, non-transferable right to access the data you input into the Mobile App to allow CHOP healthcare providers to render care, as well as internal organizational purposes, such as staff training, improving the quality of care delivered to patients and other organizational activities. As detailed above, data collected, uploaded or sent via this Mobile App may become part of your/your child's permanent medical record and may be used at the discretion of CHOP care providers.

You further grant to CHOP and to all other persons or entities involved in the operation of this Mobile App, including without limitation Epic Systems Corporation and its affiliates, the right to transmit, monitor, retrieve, store, and use your information in connection with the administration, operation and maintenance of this Mobile App, including but not limited to sharing your information with Epic Systems Corporation and its affiliates.

Use of Log File Data

In addition to the data you input into the Mobile App, this Mobile App also collects "Log File Data" or "Aggregate Information" about user properties (e.g., number of active users, where users are most engaged on the application, user retention, geographic location, mobile device platform, user adoption of new releases, source of new users, application stability, etc.) and user events (e.g., clearance of data, application removal, first open, notification sends/receipts, screen views, session starts, ecommerce purchases and in-app purchases). We use this Log File Data and Aggregate Information to maintain and improve our Mobile App.

You further grant to CHOP and to all other persons or entities involved in the operation of this Mobile App, including without limitation Epic Systems Corporation, Firebase Google Analytics and its affiliates, the right to transmit, monitor, retrieve, store, and use your Log File Data and Aggregate Information in connection with the administration, operation and maintenance of this Mobile App, including but not limited to sharing your Log File Data and Aggregate Information with Epic Systems Corporation, Google technical support and Google products and services.

Children's Privacy

We are committed to protecting the privacy of children. This Mobile App is intended for adults and young adults aged 13 and over. It is not intended for or designed to attract persons under the age of 13 (even if the patient is under 13). We do not permit registration by, nor do we collect personally identifiable information from, any person we actually know to be under the age of 13. This means that if you are the parent or legal guardian acting on behalf of a patient who is under 13, you are considered to be the exclusive user of this Mobile App, and any and all information collected, uploaded or sent via this Mobile App is provided solely by you, the parent or legal guardian, on behalf of the patient.

Other Sites

Our privacy policies apply only to your use of this Mobile App. This Mobile App may contain links to other sites, including sites that may indicate a special relationship with us. While we do not disclose personally identifiable information to those operating these linked sites, we are not responsible for the privacy practices of such other sites. You should read the privacy policies of each site you visit to determine what information that site may be collecting about you.

Push Notifications

We may send push notifications or alerts to your mobile device even when you are not using the application. By continuing with this Mobile App you are consenting to the use of such notifications. At any time, you can manage your push notification preferences or deactivate these notifications by turning off the Push Notifications settings in the device settings of your mobile device.

Changes to Our Privacy Policy

Just as with the other terms and conditions in this agreement, we may change the terms and conditions of our Privacy Policy at any time by posting revisions on this Mobile App.

You agree to review this Privacy Policy each time you use this Mobile App so that you are aware of any modifications made to these policies. By accessing or using this Mobile App, you agree to be bound by this Terms of Use and Privacy Policy as posted on this Mobile App at the time of your access or use, including the Privacy Policy then in effect.
